These Terms and Conditions (the”Terms”) are established to govern the use of CataScan (the “Application”) provided by LabSD, Inc. (the “Company”). 

Article 1 (Effect and Amendment of the Terms)

1. The Company may amend these Terms when necessary, and any changes will be posted on the initial screen of the Application.
   
   

2. If you continue to use the Application after the changes have been posted, such continued use shall be deemed acceptance of the amended Terms.

Article 2 (Nature and Purpose of the Application)

1. This Application is a non-medical self-check assessment support tool that analyzes the user's eye condition and provides reference information regarding the possibility of cataract development.
   
   

2. This Application is provided to users free of charge, and the Company does not impose any fees or charges for using the Application.
   
   

3. This Application is not a medical device, diagnostic equipment, or therapeutic tool, and must not be used for the purpose of medical judgment, diagnosis, or treatment.
   
   

4. This Application provides information for reference purposes only, and users must confirm their health status through diagnosis at medical institutions.
   
   

5. The Company makes no medical guarantees regarding the provision of the Application and assumes no liability for the reliability, accuracy, or appropriateness of the results.
   
   

6. To the maximum extent permitted by applicable law, the Application and its contents are provided "AS IS" and "AS AVAILABLE", without any warranties of any kind—whether express, implied, or statutory—including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.

Article 3 (Provision and Suspension of the Application)

1. The Company may change or suspend part or all of the Application's features for technical or operational reasons.

2. The Company may temporarily suspend the Application due to system maintenance, failure, or legal/regulatory reasons.

3. The Company shall not be held liable for any disadvantages incurred by users due to the suspension of the Application.

4. Intellectual Property Rights

1. All content, algorithms, design, UI, and other elements included in the Application are the intellectual property of the Company or third parties who have granted usage rights to the Company.

2. Users may not reproduce, distribute, modify, transmit, or display any part of the Application without the Company’s prior consent, nor may they reverse engineer or alter the Application or infringe upon any rights of the rightful owners.

5. User Responsibilities

1. Users must use the Application results solely for reference and should not make any medical decisions based on them.

2. The Company is not responsible for any health issues or damages that may arise from relying on the Application’s results. Users must obtain proper diagnosis from a medical institution.

6. Disclaimer

1. The Company shall not be liable for any damages resulting from the user’s self-judgment, misdiagnosis, or neglect of illness based on information from the Application.

2. Unless caused by willful misconduct or gross negligence, the Company is not responsible for any damages arising from temporary suspension, errors, or data loss related to the Application.

Supplementary Provision

These Terms of Use shall be effective from [2025.07.07].
